SARS Enhances Trust Dispute Process – A Step Forward or Added Pressure?

As part of its ongoing commitment to becoming a smarter and more efficient revenue service, SARS is rolling out another digital transformation. In line with Commissioner Kieswetter’s 2024 vision for a modernised tax system, the Trust Suspension of Payment (SOP) process is getting a significant upgrade.

Starting 17 February 2025, trust representatives and tax practitioners will be required to submit SOP requests exclusively via SARS eFiling. This marks a shift away from the traditional manual submission process, which has often been time-consuming and administratively burdensome. The move to a digital system aims to streamline interactions with SARS, improving efficiency and transparency in managing tax disputes.

While this development could be seen as a welcome improvement, making the process quicker and more accessible, some tax professionals and trustees may find the transition challenging. Adjusting to the new system will require a learning curve, particularly for those who have been accustomed to the manual method.

Despite potential initial hurdles, this modernisation aligns with SARS’ broader efforts to enhance compliance and simplify tax administration. Trusts and their tax representatives are encouraged to familiarise themselves with the updated eFiling procedures to ensure a smooth transition. Keeping up with these changes will be crucial in navigating the evolving tax landscape in South Africa.
